Subrogation

We are experienced in handling several types of subrogation litigation. We have the legal knowledge and experience needed to help recover insurance payments paid out by health care plans to the insured person—from the person or parties who were responsible for the injury of the insured.

Our practice also handles the subrogation (help in the recovery of paid out insurance from the responsible party) for a variety of cases regarding property and casualty insurance companies. For example if a home owner rents out their house and it burns down due to the negligence of the renter, we help the insurance company with all the legalities involved in recovery of the money paid out to the homeowner—from the negligent renter who is responsible for the fire. This same principle applies to car and personal injury accidents. In these cases we also have all the legal knowledge necessary to assist the insurance companies in obtaining reimbursement of paid out claims from the negligent, responsible party or parties.

We can also assist in cases in which liability is not clear cut. In some cases, there may be more than one party who is legally responsible for damages, and our firm can help in determining the percentage to which each person is held responsible.

Mr. Van Sant also has the advantage of having specialized knowledge about ERISA (The Employee Retirement Income Security Act of 1974) and how it impacts recovery in cases of employer sponsored benefit plans. ERISA is a very technical and challenging piece of Federal Law.
