Construction Litigation

Mr. Van Sant has extensive knowledge and experience in the area of construction litigation.  Our civil litigation practice includes representing clients in construction matters.  We represent builders, developers, subcontractors and material suppliers in all areas of construction law.  We are often called upon by his clients to represent them in court, defend lawsuit, draft construction and equipment supply agreements and advise clients on how to avoid construction claims and disputes.

We also help owners and contractors navigate the the area of law related to mechanics’ and materialmen’s lien litigation.  The lien laws were revised effective March 31, 2009 and many of the requirements and time period have been changed.  The lien laws are strictly construed and must be complied with exactly, otherwise, your lien may be unenforceable.  Maybe most importantly, a lawsuit must be filed within an abbreviated time period in order to perfect a materialmen’s lien.  If the lien is not perfect, it will expire as no longer be enforceable.  Mr. Van Sant is very knowledgeable with respect to lien laws and represents clients with materialmens liens and lien perfection claims, as well as in surety actions under the Miller Act or the Little Miller Act.
